a) Order of implementation:

* Step 1. Submit dossiers

- Within 05 working days from the day the innovative start-up investment fund is established, the company that manages the fund must send a notice of establishment of the fund to the Receiving Department of the Department of Planning and Investment at Provincial Public Administration service Center, address: 727 National Road No. 14, Tan Binh Ward, Dong Xoai City, Binh Phuoc Province where the company is headquartered before the fund operates.

- Public servants receiving dossiers checking the completeness and validity of the dossiers:

+ In case of complete and valid dossiers, receive and prepare a Letter of receiving dossiers and Letter of returning the results to the applicant.

+ In case the dossier is incomplete and invalid, guide the applicant to supplement and complete the dossier as prescribed.

- Transfer dossiers to Department of Planning and Investment for settlement.

* Step 2. Verify dossiers

- The business registration agency is responsible for reviewing the validity of the notice and attached documents within 15 working days from the date of receiving the notice.

- In case the notice and accompanying documents are valid, the business registration agency shall send a written request to the company that manages the fund on the establishment of a valid fund. In case the notice and accompanying documents are invalid according to the Government's Decree No. 38/2018 / ND-CP of March 11, 2018, the business registration agency (via the Public Administration service Center) send the document to the fund management company and specify the reason and requirements for amendments and additions (if any).

* Step 3. Return the results

The applicant should bring the Letter of receiving dossiers and Letter of returning the results to the Public Administration Service Center of Binh Phuoc Province to be instructed to perform the related obligations (if any) and receive the results.

b) Method of implementation:

+ Directly at the Public Administration Service Center of Binh Phuoc Province.

+ Sending through post office to the Public Administration Service Center of Binh Phuoc Province.

+ Submit online at the website: https://dangkyquamang.dkkd.gov.vn

c) Composition, number of dossiers:

* Composition of dossiers:

- Notice of establishment of an innovative start-up investment fund according to Form No. 01a and Form No. 01b in the enclosed Appendix of Decree No. 38/ 2018/ ND-CP of March 11, 2018 of the Government stipulating documents forms used in the notice of establishment and operation of the innovative start-up investment fund.

- Fund charter;

- Contract of hiring the company to perform fund management (if any);

- The bank's certification of the contributed capital scale;

- Certified copy of ID card, passport, citizen identification card for individual investors; establishment decisions, business registration certificates or other equivalent documents for investors being organizations;

- Minutes of meetings and decisions of the General Meeting of Shareholders or the Board of Directors, decisions of the Members' Council or of the owner in accordance with the provisions of the company's charter of the investors being organizations that contribute capital about the capital contribution to the fund, the appointment of the representative of the capital contribution as authorized, together with this person's personal dossier.

* Number of dossier: 01 set.

d) Time limit for settlement: Business Registration agency is responsible for reviewing the validity of the notice and attached documents within 15 working days from the date of receipt of the notice.

d) Subjects carrying out administrative procedures: Organization.

e) Agencies carrying out administrative procedures:

- Competent authority for settlement: Department of Planning and Investment.

- Agency directly implementing: Business Registration Division - Department of Planning and Investment.

g) Results of carrying out administrative procedures: Documents sent to the fund management company on establishment of a valid fund and enterprise profile updated on the National Business Registration Portal.

h) Fees: none

i) Name of application form and declaration form:

- Form No. 01a: Notice of establishment of an innovative start-up investment fund, issued together with Decree No. 38/2018 / ND-CP.

- Form No. 01b: List of investors contributing capital to innovative start-up investment fund, issued together with Decree No. 38/2018 / ND-CP.

k) Requirements and conditions for carrying out administrative procedures:

- Maximum of 30 investors contributing capital for establishment.

- Investors are not allowed to use loan capital to contribute capital to set up innovative start-up investment funds.
